Alabama Dem vows ‘independent judgment’ on Trump Supreme Court pick

Some broadcast TV networks are quietly clearing the deck in anticipation of President Donald Trump's announcement of his nominee to succeed Justice Anthony Kennedy on the Supreme Court. On Sunday there was no indication that he had yet made his decision, as speculation continued to swirl around the appointment. In the presidential debates he vowed to appoint only justices committed to "automatically" overturning Roe v Wade, the precedent which affirmed abortion as legal until the age of viability of the fetus, normally put at 23 or 24 weeks of pregnancy. He's also had a hand in Trump's picks for lower courts; the president has gotten a whopping 21 circuit court judges confirmed since taking office and almost all were outsourced to The Federalist Society to fill.

According to National Public Radio (NPR), Trump has reduced the names of the potential nominees to three judges - Brett Kavanaugh, Amy Coney Barrett and Raymond Kethledge.

Asked by anchor George Stephanopoulos about Democrats' fear that the candidate selected will be opposed to the 1973 ruling legalizing abortion, Leo brushed it off as a "scare tactic".

"The Republicans control the votes in the Senate, but we have the American people on our side", he said.

Republican Sens. Lindsey Graham of SC and Roy Blunt of Missouri said Sunday that they believe any of the top four contenders could get confirmed by the GOP-majority Senate.

While careful not to directly make the case for any would-be justice, McConnell, R-Ky., made clear in multiple phone calls with Trump and White House counsel Don McGahn that the lengthy paper trail of another top contender, Judge Brett Kavanaugh, would pose difficulties for his confirmation.

Trump's Monday night nomination will be his second since he entered the White House. Mr. Trump finally nominated judge Neil Gorsuch. It's also possible he could be trying to nudge Trump toward picking Barrett. He namechecked Leo's Federalist Society and the rightwing Heritage Foundation.
