Unlike Rosenstein and Attorney General Jeff Sessions, who recused himself from the special counsel investigation, Brand has kept a low public profile and has not been scrutinized by Trump.

Last summer on Twitter, Trump called Sessions "beleaguered" and "very weak, and at a news conference in the Rose Garden said he was "disappointed in Sessions".

Brand's resignation is different in the sense that she was hand-picked for the job by Trump, assuming her post just five days after Mueller's appointment in May 2017. Her departure could impact the future of the Russian Federation investigation overseen by Special Counsel Robert Mueller.

Associate Attorney General Rachel Brand is leaving the DOJ for the top legal job at Walmart, a on the department's website confirmed Friday.

"Rachel has shown real leadership over many important divisions at the department", Sessions said in a statement Friday night in which he congratulated Brand.

Walmart sought Brand to be head of global corporate governance at the retail giant, a position a friend and former colleague, Jamie Gorelick, said has legal and policy responsibilities that will cater to her strengths.

"We are fortunate to have a leader of Rachel Brand's stature join the company", CEO Doug McMillon in the statement.

Brand served only nine months in the role and will take a job in the private sector, NBC and the Times reported.

The department is also facing a major backlog on leadership positions that still need confirmation by the US Senate.

A 2016 Justice Department memo outlines the order of succession in overseeing the investigation if Rosenstein is recused or removed before Brand is replaced, according to Buzzfeed. "I've seen firsthand his commitment to the rule of law and to keeping the American people safe".

During the Obama administration, Brand served on the Privacy and Civil Liberties Oversight Board, which studied the 702 program two years ago. With her gone, the next person in line is Solicitor General Noel Francisco.

Trump has always been publicly raged against the probe - which he frequently describes as a "witch hunt" - and reportedly called for Mueller to be sacked over the summer, but backed off when White House counsel Don McGahn threatened to resign.

When Trump was asked by a reporter whether he was then more likely to fire Rosenstein and whether he had confidence in him, Trump replied "you figure that one out".
