Ex-Penn St officials get jail terms in Sandusky abuse case

Three former Pennsylvania State University officials were sentenced to jail on Friday for covering up ex-coach Jerry Sandusky's sexual predations and effectively letting him victimize more boys.

Spanier, 69, was convicted one week after guilty pleas from former Athletic Director Tim Curley and former Senior Vice President for Finance and Business Gary Schultz on misdemeanor charges of child endangerment.

"Today's sentencings, which landed all three defendants behind bars, leaves no doubt that there are consequences for failing to protect children in Pennsylvania", state Attorney General Josh Shapiro said in a statement. Spanier's lawyer says the 68-year-old is suffering from prostate cancer and heart problems, and is asking for probation. Sandusky was convicted the next year of sexually abusing 10 boys and is serving 30 to 60 years in prison.

Deputy Attorney General Patrick Schulte also pointed a finger at Paterno for the cover-up itself, saying the trio of administrators had meant to report Sandusky to child welfare officials until they met with Paterno after the shower incident. At least four victims at Sandusky's trial said they were molested after 2001.

Spanier's trial revolved around testimony by an ex-graduate coaching assistant, Mike McQueary, who said he reported seeing Sandusky molesting a boy in 2001. Penn State's former university counsel, Cynthia Baldwin, who the men thought was representing them personally, actually represented only the university and eventually testified against them in grand jury proceedings.

Prosecutor Patrick Schulte said Curley at one point had drawn up a plan to report Sandusky to state authorities, but “something changed after talking to coach Paterno.”.

She said he kept Penn State trustees in the dark about the Sandusky complaint and "he allowed children to be harmed".

Sandusky was not arrested until 2011, after an anonymous tip led prosecutors to investigate. He is scheduled to return to court Friday for sentencing. Paterno was sacked but never charged with a crime; he died of lung cancer at age 85 two months after Sanduskys arrest. But he also chided them for what he said was an inexcusable failure.

Penn State has paid out almost a quarter-billion dollars in fines, settlements and other costs associated with the scandal, and the football program suffered heavy NCAA sanctions.

Curley and Schultz also told the court they were sorry they didn't do more.

Both the judge and prosecutors Friday thrust blame onto Paterno himself. Schultz and Curley are mandated to pay $5,000 fines, and Spanier will pay $7,500.

"I pleaded guilty because I felt like I should have done more", Curley said.
