Federal judge tosses out life sentences for DC sniper Malvo

A federal judge has thrown out two life sentences being served by Lee Boyd Malvo, one of two people convicted in the Washington, D.C., sniper killings of 2002.

In 2012, the US Supreme Court ruled such sentences unconstitutional for juveniles and later found that the ruling should be applied retroactively.

The shooting spree killed 10 people and wounded three across Maryland, Virginia and Washington, DC, over three weeks in October 2002.

Malvo's case has been remanded back to Spotsylvania County Circuit Court to issue a new sentence.

He would eventually be sentenced to another life term for another murder in Virginia and six more consecutive life sentences for murders committed in Maryland. A hearing is scheduled in June.

The Associated Press reported that Fairfax County Commonwealth's Attorney Ray Morrogh, who helped prosecute Malvo, said the Virginia attorney general can appeal Jackson's ruling.

Now 32, Malvo is serving multiple life sentences at Red Onion State Prison in Virginia, a supermax prison. Malvo could still receive life sentences again based on new standards in those two counties.

Prosecutors sought the death penalty for Malvo as well, for the slaying in Fairfax of Linda Franklin outside a Home Depot in the Falls Church area.

As they traveled, Muhammad and Malvo carried out a series of murders across the country, beginning in Washington state.

The order was handed down Friday, May 26 by Judge Raymond Jackson. Muhammad was executed via lethal injection on November 10, 2009.

"I couldn't say no", he said in the interview. Malvo's entire trial was essentially a sentencing hearing, as Cooley and Arif told a life story of abuse and neglect by his mother, and brainwashing by Muhammad.
